These Terms of Service govern your use of Birch ("the Service"), a messaging-based parenting support service operated by Birch. By initiating a conversation with Birch via WhatsApp, Telegram, or any other supported messaging platform, you agree to these terms.
Birch is an AI-assisted service that helps parents support their children's learning at home. Once you set up an account, Birch sends you one personalised activity message per day and responds to questions about your child's learning and development.
Birch is designed for parents of children aged approximately 3–10 years. It is not a clinical, medical, or therapeutic service. Information provided by Birch is for general educational guidance only and does not constitute professional advice.
AI-generated content: All messages and responses from Birch are generated automatically by artificial intelligence and have not been reviewed by a qualified professional before delivery. Birch is not a substitute for the advice of a teacher, paediatrician, psychologist, speech therapist, or any other qualified professional.
You must be at least 18 years old and the parent or legal guardian of the child or children you register with the Service. By using Birch, you confirm that you have the authority to share information about your child for the purpose of personalising the Service.
You may use Birch for personal, non-commercial purposes. You agree not to:
Birch provides general educational guidance based on publicly available child development research and the information you share. It does not replace professional advice from teachers, paediatricians, psychologists, speech therapists, or other qualified professionals.
If you have concerns about your child's health, development, or wellbeing that may require professional attention, please contact an appropriate professional. Birch may point you toward relevant professionals, but this is not a referral service and does not constitute a professional recommendation.
Not a mental health service: Birch is not a mental health service and is not equipped to handle mental health crises for parents or children. If you are experiencing a mental health emergency, please contact emergency services or a crisis helpline immediately. In Spain: 024 (mental health crisis line) or 112 (emergencies).
We make reasonable efforts to ensure the accuracy of information provided, but we cannot guarantee that all guidance is correct, current, or appropriate for your specific situation.
When you share information with Birch — about your child, your family, or your situation — you retain ownership of that information. You grant us a limited licence to use it solely for the purpose of providing the Service to you personally.
We do not use the content of your conversations to train AI models, to improve AI systems generally, or to share with third parties for their own purposes. Conversation content is transmitted to our AI provider (Anthropic) solely to generate your responses and is not retained by them for model training.
You are responsible for the accuracy of information you provide. Please do not share sensitive personal information beyond what is needed to personalise the Service.
Birch is currently in an early access phase. We will notify you clearly and in advance before any paid features are introduced. Free features will be clearly distinguished from any paid tier. We will never charge you without your explicit, informed consent.
Birch is delivered via third-party messaging platforms including WhatsApp and Telegram. We are not responsible for interruptions, errors, or service changes caused by these platforms. If a platform is unavailable, your Birch messages may be delayed or undeliverable. We will not issue refunds for outages caused by third-party platforms.
Your use of WhatsApp or Telegram is also subject to those platforms' own terms of service and privacy policies, which are independent of Birch.
We may update, modify, or discontinue features of the Service at any time. If we make significant changes that affect your use of the Service, we will notify you via the messaging platform you use to access Birch before those changes take effect.
You may stop receiving messages from Birch at any time by sending /pause to the bot. To permanently delete all your data, send /deletedata to the bot and follow the confirmation step — your data will be removed within 30 days. You may also request deletion by emailing hello@withbirch.com.
We may suspend or terminate access to the Service if we believe these Terms have been violated. In such cases, we will notify you and delete your data in accordance with our Privacy Policy.
The Service is provided "as is" and "as available." We make no warranties, express or implied, about the suitability, reliability, availability, or accuracy of the Service for any purpose. We do not warrant that the Service will be error-free or uninterrupted.
To the maximum extent permitted by applicable Spanish consumer law, Birch is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on any information provided by the AI. This does not affect any statutory rights you have as a consumer under Spanish or EU law, which cannot be excluded.
We aim to resolve any concerns or disputes informally. If you have a complaint, please contact us at hello@withbirch.com and we will make a good-faith effort to resolve it within 14 days. If we cannot resolve the matter informally, disputes shall be subject to the laws of Spain and the jurisdiction of the courts of Madrid.
As a consumer in the EU, you may also have the right to access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
These Terms are governed by the laws of Spain. Nothing in these Terms affects your rights as a consumer under applicable EU or Spanish law.
